This summary has been provided to help you better understand the terms and conditions that govern all advertising, sponsored content and production booked with CarExpert NZ.
However, please note that this is not a legally binding summary. Read our full terms and conditions (Legal Terms). These Legal Terms constitute the binding contract between us in relation to any advertising booked.
Advertising with us
- To advertise with CarExpert NZ you must submit a completed Insertion Order, which we will also sign.
- We will endeavor to reach any campaign targets but we do not guarantee this.
- If we determine the campaign targets have been missed by more than 10%, we may remedy this by providing additional impressions of your ad in the following months but we won’t provide a refund or credit (but this doesn’t apply to Bonus Ads or Advertiser SOV).
- If an Insertion Order including Bonus Ads or Advertiser SOV has set metrics that are not met, we are not liable to provide a refund, reimbursement or credit.
- We will not issue a refund for advertising services not delivered in line with this Agreement. Your only option is to request a make-good, which may involve publishing your ad in a subsequent month, providing services of equal value or extending an initial campaign.
- You cannot sell or transfer the advertising space you are allocated by us.
- You must not disclose any details of your agreement or our Rate Card to any third parties and must comply with our privacy policy.
Submitting advertising material
- You are responsible for supplying material within Lead Times, which is formatted in line with our advertising specifications.
- You must ensure your material is not misleading, illegal, offensive, defamatory, or unsuitable for anyone aged under 18. It must also be virus-free and not contain any tracking or collection device that could compromise the CarExpert NZ network.
- We retain the right to cancel and remove any ad immediately that is in breach of our requirements. In some cases, we may give you
48 hours to provide a replacement. - Your material must not suggest endorsement or affiliation with CarExpert NZ or any third-party website or reference or promote a CarExpert NZ competitor.
- Ad placement is allocated on a first-in basis and cannot be guaranteed. Additionally, we cannot guarantee that your ad will not appear next to competitors or incompatible products.

Requesting changes
- You need to complete a Change Request to vary your Insertion Order and we must receive it before the publishing date.
- We are not required to accept a Change Request but, if we do, we will advise you about any changes to the fees, co-sign it and discuss any updates to the
Insertion Order. - We will notify you about any changes we make to our advertising products and ensure we discuss any changes to your Insertion Order.
Approving and publishing ads
- You need to approve or advise any changes to the mock-ups for custom material at least two business days ahead of publishing. If we do not hear from you, we will consider it approved. One change is on us, for all other changes you will need to pay.
- We retain editorial control of ads, including format, position, placement and publishing.
Cancelling ads
- You can cancel an ad campaign at any time for whatever reason. To avoid a charge, give us:
- - 30 days’ written notice before the publishing date for standard campaigns
- - 90 days’ written notice before the publishing date for baseline campaigns.
- If you cancel an order for CarExpert NZ’s creative services, we charge any costs incurred up to that date, including any cancellation fees.
Measuring campaign performance
- If your ad is underperforming, we may change its placement ensuring we still give you an equivalent size space and environment.
- We measure your ad performance through our own advertising tracking systems to determine whether campaign targets have been met.
Paying fees and costs
- Your fees payable are outlined in the Insertion Order. While rates and charges quoted exclude GST, you will need to pay any applicable taxes. If you cannot find fees specified, refer to CarExpert’s Rate Card at the time of accepting the order.
- We invoice you each month and you will have 45 days to pay (unless advised otherwise). Invoices are calculated on services booked rather than services delivered.
- If you are late paying, we will likely charge:
- - interest and late fees monthly on the overdue amount at a rate of 3% above the RBNZ official cash rate
- - expenses we pay in recovering money through legal or collection agencies.
Ending our Agreement
- CarExpert NZ can terminate this Agreement at any time with 30 days’ written notice.
- The Agreement can be terminated in writing immediately if either party:
- - is insolvent
- - breaches a provision not capable of remedy or that is capable of remedy but fails to remedy it within 14 days.
- On expiry of the agreement, you must pay all outstanding fees and return any custom material to us.
Not legally binding
- Once again, this is a summary only of our Legal Terms. In the Insertion Order, you will be accepting our full Legal Terms so please ensure that you read them in full before signing the Insertion Order.
- If there is any inconsistency in this summary of our Legal Terms and the Legal Terms, then the Legal Terms will prevail, which is why it is essential that you read them in full.
